Happy Staffie Rescue values your support and takes great care about the data we may hold about you. We are committed to protecting your personal information. This policy sets out how Happy Staffie Rescue uses the information that you provide us with to help further our work in protecting dog welfare.

About us

Happy Staffie Rescue is a dog rescue that specialises in Staffordshire bull terriers and related bull breeds and cross breeds. Founded in 2009 we have promised to never put down a healthy dog.

Under no circumstances will we ever sell your data to any third parties. We do not use your data for targeting marketing, fundraising or other income generating methods that are commonly used by other charities.

Your Information – what we collect and how we use it

Happy Staffie Rescue collects information from the public in several different ways. For example, we ask for contact and other information when members of the public rehome or adopt a dog, become a regular monthly or annual donor, or communicate with us and become supporters that fundraise or volunteer their time with us. This may include information such as your name, date of birth and contact information. We use this information to help us provide and improve our services as a charity and to keep a record of our communications with you.

If you are a financial supporter of Happy Staffie Rescue, by becoming a member, or donating to us we will ask for information that enables us to administer your donation. This will normally include information such as your name, contact details such as address, email or telephone number and your payment details and Gift Aid status.

If you are a person that adopts a dog from us, or donates £25 or more in a single donation, you will become a member of our Supporter’s Club which means we will write to you 3-4 times a year with a copy of our newsletter. You can withdraw your consent for us to send out these newsletters at any time.

If you are a person that donates on a regular basis a sum equivalent to or greater than £2 per week you will become a member of our Supporter’s Club which means we will write to you 3-4 times a year with a copy of our newsletter. You can withdraw your consent for us to send out these newsletters at any time.

The way we contact you with our newsletter (which may include a letter about your membership starting or coming to an end) with depend on the method you have chosen and that will be either e-mail or by post. We will not contact you by telephone unless this is required in order to address an issue, or respond to an enquiry.

What the Law says about protection of personal information

The Law on Data Protection is derived from various pieces of legislation. These include the Data Protection Act and the General Data Protection Regulation (the ‘GDPR’).

The GDPR states that personal data (information relating to a person that can be individually identified) can only be processed if there is a legal ground to do so. Activities like collecting, storing and using personal information would fall into the GDPR’s definition of processing. The GDPR provides six legal grounds (reasons) under which personal information can be processed (used) in a way that is lawful. For the processing to be permitted by law (lawful), at least one of the legal grounds must apply.

The four legal grounds that are most relevant to Happy Staffie Rescue’s use of your personal information are:

How the law applies to Happy Staffie Rescue’s use of personal information

Happy Staffie Rescue will only process (use) your personal information if we have:

asked you and have a record of your express and recent consent for us to do so;
a ‘Legitimate Interest’ to do so in order to support our charitable purposes. Our use will be fair and balanced and never unduly have an impact on your rights.;
a contract with you that we can only fulfil by using your personal information, e.g. to send you an item that you have requested;
a legal obligation to use or disclose information about you, e.g. we are required by law to keep records of gifts that are given to us with Gift Aid for 4 years; and we are compelled to disclose information relating to incidents involving dangerous dogs for insurance purposes under the Dangerous Dogs Act.

If you are already an existing member of our Supporter’s Club you can withdraw your consent at any time by writing to us at the address or e-mail address at the bottom of this page.

In extreme situations, such as an accident or medical emergency, we may share your personal details with the emergency services if it is essential for the preservation of life (yours or another persons’) for us to do so. This is the ‘vital interest’ ground for using your personal information. After the emergency, we will always try to inform you about how we had to use your information in that extreme situation.

We will not unduly prioritise our interests as a charity over your interests as an individual. We will always balance our interests with your rights. We will only use personal information in a way and for a purpose that you would reasonably expect in accordance with this Policy.

Happy Staffie Rescue will not rent, swap or sell your personal information to other organisations for them to use in their own marketing activities.

Consent

From May 2018, Happy Staffie Rescue will always ask for your consent before we communicate with you for certain purposes. For example, we will only email or phone you about our fundraising activities if we have an accurate record of your recent and freely given consent to do so.

You can withdraw your consent at any time by writing to us or e-mailing us at the addresses at the bottom of this page.

There are times when it is not practical to obtain and record consent. At those times, we will only process personal information if that processing would meet another legal ground e.g. Legitimate Interests, in which case we would only process in accordance with the law’s strict rules on legitimate interest processing.

What is Legitimate Interest

The law for processing your date means that can process your data if we have a genuine and legitimate reason for doing so, and that use of your data does not infringe your rights as an individual. An example of this may be that you withdraw consent for us to contact you as a Supporter, so we will stop sending you our newsletter 3-4 times a year, but we have a legitimate reason to contact you if you membership comes to an end. Likewise, if you are a Gift Aid donor to our charity shops we may periodically write to you to advise you how much was raised by your donations – you cannot withdraw consent for these letters to go out as we are required by HM Revenue & Customs to send them.

Happy Staffie Rescue’s Legitimate Interest

We have looked at the legitimate interests of our supporters and believe we have the following categories:

dog adoptions; we believe that you and the dog rehomed from us would like to remain in contact with us throughout their lifetime and we will therefore keep your personal information to allow us to do this. If the dog you adopted is no longer in your care for whatever reason you can inform us and we will remove the data that we hold about you.
Micro-chipping; we will keep a record of your information and the details of the dog and microchip number and we will forward this information to the relevant authorised body that maintains the microchip database. This is a condition of you adopting a dog from us.
Supporting us financially; you may donate once, or regularly but we will be required to keep a record of the information you gave us about you if it supports the evidence required as part of our accounts which have to be independently examined each year by an accountant, and available for inspection by HM Revenue & Customs as required.
Showing an interest in Happy Staffie Rescue; you may contact us to offer your support by way of an enquiry. You may have contacted us to offer your help in fundraising, or another way of support. By doing so we have a legitimate reason to retain data about you in order to continue our relationship.

Legitimate Interest to send you direct mail

Unless you tell us not to, we will rely on our Legitimate Interest ground (explained above) for sending you direct mail. We will only do this as part of your membership of our Supporter’s Club, and this will be in the form of a newsletter that is normally published 3-4 times a year and may include a separate supporting letter and very occasionally marketing or advertising material in the form of generalised leaflets (and nothing that involves your data being shared with a third party). You may withdraw your consent for us to send you our newsletters, but we will still retain a legitimate reason to contact you at the end of your membership.

Legitimate Interest to process your information

We will only process your information in the following ways:

To process your donations
To fulfil your transactions with us, sending items you have purchased, taking payment, processing delivery.
To send you postal or e-mail communications as part of our Supporters Club, in response to your enquiry, to thank you for a donation.
The lawful and legitimate processing of data pursuant to accurately recording our accounts

Data Sharing

To help us communicate the work we are doing and provide these services we use trusted service providers including fundraising agencies, electronic data analysis and marketing agencies and direct mailing providers.

Happy Staffie Rescue do not share, sell or swap your information with other organisation for their own marketing outside of our group.

In some circumstances it is necessary for Happy Staffie Rescue to give relevant staff at our service providers access to your personal information. This access is only granted to the extent necessary for them to perform their services for us. We require all service providers to comply with strict rules to protect the information you have given us.

We may share your good news stories with our supporters via our Facebook page, Twitter, Instagram, Tumblr and our newsletter. You have the right to refuse us from doing this.

Changes to your data

From time to time we may contact you to ensure that the information you have provided us with remains accurate and up to date.

Like all organisations, we comply with requests for the disclosure of personal information where this is required or permitted by law. This could include requests from law enforcement or tax agencies. In these circumstances, the request must be submitted in writing and in accordance with the relevant legal requirements.

The collection of information

Every time you log on to our website your IP (Internet Protocol) address registers on our servers. Your IP address reveals no information other than the number assigned to you. Emails

Some emails that we send you have no tracking in at all e.g. service emails with invoices attached. Other emails we send we can track, at an individual level, whether the user has opened and clicked on the email. We do not use this information at a personal level, rather we use it to understand open and click rates on our emails to try and improve them. If you want to be sure that none of your email activity is tracked then you should opt out of our emails which you can do via the unsubscribe link at the bottom of every email we send.

Web Security

Financial transactions made online to Happy Staffie Rescue using this site are secured by the third party payment providers – Justgiving and PayPal.
